Data controller
Cloudsoft Industries LLC, a company organized in Delaware, USA with an engineering studio in Armenia, Quindío, Colombia (“Cloudsoft”), is responsible for the personal data collected through https://www.cloudsoft.com.co and through the services provided to its clients. For any data protection matter, write to hola@cloudsoft.site.
Because our team operates from Colombia, we apply Law 1581 of 2012, Decree 1377 of 2013 and related Colombian rules, together with any applicable United States privacy law.
Data we collect
We only collect the data needed to provide our services and meet legal obligations:
- Contact data: name, email, phone, company and message, when you fill in the contact form or write to us.
- Contract data: legal name, tax ID (EIN, NIT or equivalent), address and billing details needed to issue invoices and meet tax obligations.
- Technical data: IP address, browser type, pages visited and anonymous usage metrics, collected through cookies and analytics tools.
- Data shared during a project: information the Client chooses to share to carry out the service, handled under the signed contract and in confidence.
Why we use it
- To answer requests for information and prepare proposals.
- To deliver the services hired and provide support.
- To issue invoices and meet tax obligations.
- To send updates on project status or contract changes.
- To improve the website through aggregated, anonymous analytics.
- To send occasional marketing messages, only with your prior, explicit and revocable consent.
Legal basis
We process data on the basis of the data subject’s prior, explicit and informed consent; the performance of a contract the data subject is party to; compliance with legal obligations that apply to Cloudsoft; and, where relevant, legitimate interests compatible with the data subject’s rights.
Your rights
As a data subject you have the right to:
- Access, update and correct your personal data.
- Request proof of the consent you gave.
- Be informed about how your data has been used.
- File complaints with the competent authority (in Colombia, the Superintendencia de Industria y Comercio).
- Withdraw consent and/or request deletion of your data.
- Access your personal data free of charge.
To exercise any of these rights, email hola@cloudsoft.site stating your request clearly. We will reply within the time limits set by law.
Sharing with third parties
We do not sell personal data. We only share information with technology providers essential to deliver our services (cloud providers, payment processors, transactional email providers, analytics platforms), all bound by contracts that require equivalent protection.
Card payments are processed by Stripe, Inc. Card details go directly to Stripe and Cloudsoft never stores them. Stripe handles that information under its own privacy policy.
Some providers process data outside your country. In those cases we apply the safeguards required for international data transfers.
Retention
We keep data for as long as needed for the purposes described and to meet applicable legal obligations, especially tax and accounting ones. After that, we securely delete or anonymize it.
Security
We apply reasonable technical, administrative and physical measures to protect personal data: encryption in transit (TLS), access controls, audit logs, backups and incident response plans. No system is infallible; if an incident affects personal data, we will notify the authorities and data subjects as required.
Changes to this policy
We may update this policy. The current version is published at https://www.cloudsoft.com.co/en/legal/privacy with its last-updated date at the top.
